17th Century Hungarians knew a thing or two about tort reform

From Elizabeth Báthory's Wikipedia page:

At the trial [in 1611] there were accusations of pagan practices and witchcraft. The trial did not follow modern judicial standards, instead using torture and intimidation of both the accused as well as some of those who testified against them, as was common at that time.

Talk about a disincentive to bring suit; both plaintiffs and defendants were subject to torture and intimidation.
